1. The attorneys should never accept the adjuster as a reliable source; the adjuster’s opinion never counts. In particular, the attorney should never believe an adjuster’s statement that an offer is “final” or “the highest one that will be made.” In general, this is not true.
2. The attorney should not use policy limits to determine the maximum the victim can receive. A good attorney will investigate for other policies or income sources to compensate an injured victim.
3. The attorney should not let the adjuster define the value of the case by offering a low settlement. The attorney should set the value of the case, and be prepared to go to trial for it.
4. The attorney should use his experience to set the high and low range of value of the case before negotiating. Otherwise, the attorney may make an offer that is too low, and the adjuster and insurance attorneys will use this to discount the value of the case.
